Welcome to Cart IoT. These Terms of Service ("Terms") govern your access to and use of the Cart IoT website, products, software, and services (collectively, the "Services") provided by Cart IoT ("we," "our," or "us"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

Acceptance of Terms

By creating an account, making a purchase, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, providing additional notice. Your continued use of the Services after any modifications constitutes your acceptance of the revised Terms.

Use of Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete information when creating an account or submitting inquiries.
  • Not use the Services in any manner that could damage, disable, overburden, or impair our servers or interfere with any other party's use of the Services.
  • Not attempt to gain unauthorized access to any part of the Services, other accounts, computer systems, or networks connected to the Services.
  • Not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without our express written permission.
  • Comply with all applicable local, state, national, and international laws and regulations.

Products and Purchases

All product descriptions, pricing, and availability are subject to change without notice. We reserve the right to limit the quantity of any product or service that we offer and to discontinue any product at any time.

When you place an order through our Services, you represent that the information you provide is accurate and that you are authorized to use the payment method provided.

IoT hardware products are sold subject to their applicable warranty terms provided at the time of purchase. Software services and cloud platform access are provided on a subscription basis as described in the applicable service agreement.

CHARGER SAFETY Device Disclaimer

IMPORTANT: CHARGER SAFETY IS NOT A LIFE SAFETY DEVICE. The CHARGER SAFETY device and associated monitoring services are intended for supplemental monitoring of charging activity for golf carts, low-speed electric vehicles, and similar equipment. CHARGER SAFETY is not a smoke detector, fire alarm, fire suppression system, or any form of life safety device, and it is not intended to replace any such device.

You acknowledge and agree that:

  • CHARGER SAFETY provides supplemental monitoring only and should not be relied upon as a primary means of detecting or preventing fire, electrical faults, or other hazardous conditions.
  • The monitoring service depends on functioning Wi-Fi connectivity, cellular network availability (where applicable), internet service, cloud infrastructure, and device power. Any interruption to these services may delay or completely prevent delivery of alerts and notifications.
  • Service outages, maintenance windows, network congestion, carrier issues, software updates, and other factors beyond our control may result in delayed, missed, or undelivered notifications.
  • You are solely responsible for maintaining appropriate fire detection and life safety equipment (including smoke detectors, fire alarms, and fire extinguishers) in compliance with all applicable local, state, and federal regulations.
  • Cart IoT does not guarantee uninterrupted or error-free operation of the CHARGER SAFETY device or monitoring service, and shall not be liable for any damages resulting from delayed, missed, or failed alerts or notifications.
  • The CHARGER SAFETY device monitors conditions but does not independently take action to prevent fires or other hazards. Any automated responses (such as power cycling) are convenience features and should not be relied upon as safety mechanisms.

BY USING CHARGER SAFETY, YOU ACKNOWLEDGE THAT IT IS A SUPPLEMENTAL MONITORING TOOL AND NOT A SUBSTITUTE FOR PROPER FIRE DETECTION, FIRE PREVENTION, AND LIFE SAFETY EQUIPMENT.

Subscription Terms and Recurring Billing

Subscription Plans

The CHARGER SAFETY monitoring service is provided on a monthly subscription basis. By subscribing, you agree to the following terms:

Recurring Charges. Your subscription will automatically renew at the end of each billing period (monthly) at the then-current subscription rate. You authorize Cart IoT to charge your payment method on file for each renewal period until you cancel. We will notify you of any price changes before they take effect.

Billing. Subscription fees are billed in advance at the beginning of each billing period. All fees are stated in U.S. dollars and are exclusive of applicable taxes, which will be added at checkout.

Payment Method. You must provide a valid payment method to subscribe. If your payment method fails or is declined, we will attempt to collect payment according to our payment processor's retry schedule. If all payment attempts fail, your subscription will be cancelled and your access to the monitoring service will be suspended.

No Refunds. Subscription fees are non-refundable. If you cancel your subscription, you will retain access to the monitoring service through the end of your current paid billing period. No partial-month refunds or credits will be issued.

Cancellation

You may cancel your subscription at any time through the Billing Portal accessible at cartiot.com. Upon cancellation:

  • Your monitoring service will remain active through the end of your current paid billing period.
  • At the end of the billing period, your device access will be suspended and your account login will be disabled.
  • Your CHARGER SAFETY device will remain installed but will no longer transmit monitoring data or generate alerts.
  • No refunds or credits will be provided for the unused portion of the current billing period.
  • You may reactivate your subscription at any time by visiting cartiot.com/reactivate and providing a valid payment method. Upon reactivation, your monitoring service and account access will be restored.

Subscription Modifications

Cart IoT reserves the right to modify subscription pricing, features, or terms with at least thirty (30) days' advance notice. Continued use of the service after the effective date of any modification constitutes your acceptance of the modified terms. If you do not agree with the modifications, you may cancel your subscription before the changes take effect.

Installation and Service

CHARGER SAFETY devices should be installed by an authorized Cart IoT dealer. A list of authorized dealers is available at cartiot.com/find-a-dealer. Installation by an authorized dealer ensures proper setup, configuration, and activation of your device.

Cart IoT is not responsible for device malfunction, damage, or performance issues resulting from installation, modification, or servicing by any party other than an authorized Cart IoT dealer. Tampering with, modifying, or servicing the CHARGER SAFETY device outside of the authorized dealer network may void your warranty and may result in device malfunction.

For fleet customers purchasing directly from Cart IoT, installation services are provided by Cart IoT or its designated representatives.

Service Availability

Cart IoT will use commercially reasonable efforts to maintain the availability of the CHARGER SAFETY monitoring service. However, the service is provided "as is" and "as available." We do not guarantee that the service will be uninterrupted, timely, secure, or error-free.

Planned maintenance will be performed during off-peak hours when possible. We will endeavor to provide advance notice of planned maintenance that may affect service availability, but are not obligated to do so.

The monitoring service relies on third-party infrastructure including, but not limited to, internet service providers, cellular carriers, cloud hosting providers, and Wi-Fi networks. Cart IoT is not responsible for outages, delays, or failures caused by third-party services or infrastructure outside of our control.

Hardware Warranty

CHARGER SAFETY hardware is covered by a limited warranty as described in the warranty documentation provided with your device at the time of purchase or installation. The warranty covers defects in materials and workmanship under normal use. The warranty does not cover damage caused by misuse, unauthorized modification, improper installation, accidents, environmental conditions, or normal wear and tear.

Warranty claims should be submitted to your authorized Cart IoT dealer or directly to Cart IoT at [email protected].

Device Data and Telemetry

Your CHARGER SAFETY device transmits operational data to Cart IoT's cloud platform, including but not limited to: charging status, temperature readings, voltage and current measurements, connectivity status, and device health metrics. This data is used to:

  • Provide the monitoring service and generate alerts.
  • Analyze device performance and improve the service.
  • Generate aggregated, de-identified data for research and safety analysis.

You grant Cart IoT a non-exclusive, royalty-free license to use, store, and process device telemetry data for the purposes described above. Aggregated, de-identified telemetry data may be used for research, safety analysis, and publication without further notice or consent. For details on how personal information is handled, refer to our Privacy Policy.

Upon cancellation or termination of your subscription, telemetry data associated with your device may be retained in aggregated, de-identified form for research and safety analysis purposes.

Share Access and Invitations

Cart IoT allows account holders to invite other users to share access to their carts. By using the share access feature, you agree to the following:

  • You may only invite individuals whose email addresses you are authorized to use for this purpose.
  • Invited users must create an account and accept these Terms and our Privacy Policy before accessing shared carts.
  • As a cart owner, you are responsible for managing who has shared access to your carts. You may revoke shared access at any time.
  • Shared users have full access to cart data and device controls but cannot modify billing or remove accounts.
  • Shared users may invite additional users to a cart, but only the cart owner can revoke shared access or cancel pending invitations.
  • When you share access, your name and email address will be visible to shared users, and their name and email address will be visible to you.
  • Invitation links are single-use and expire after a set period. Expired or used invitation links cannot be reused.

Cart IoT is not responsible for any actions taken by users you have invited to share access to your carts. You assume all responsibility for granting shared access.

User-Uploaded Content

You may upload content to the Services, including cart profile photos and maintenance record images. By uploading content, you agree to the following:

  • You retain ownership of content you upload, but you grant Cart IoT a non-exclusive, royalty-free license to store, display, and process that content as necessary to provide the Services.
  • Uploaded images are processed on your device (resized and compressed) before being transmitted to our servers. Cart IoT does not receive or store unprocessed original images.
  • You represent that you have the right to upload any content you submit and that such content does not violate any third party's rights or any applicable law.
  • Cart profile photos are visible to all users who have access to that cart, including shared users.
  • Cart IoT may remove uploaded content that violates these Terms or is otherwise objectionable, without prior notice.

Upon deletion of your account or removal of a cart, associated uploaded content will be deleted in accordance with our data retention practices described in our Privacy Policy.

Home Screen Widgets

The Cart IoT mobile app may offer home screen widgets that display summary device information (such as battery level and charging status). By using widgets, you acknowledge and agree that:

  • Widget data is cached locally on your device and may not reflect real-time device status. Data displayed in widgets is refreshed periodically and may be delayed.
  • Widgets depend on your device's operating system and may be subject to limitations imposed by Apple iOS or Google Android, including refresh frequency restrictions.
  • Widget functionality may vary by device and operating system version. Cart IoT does not guarantee widget availability or compatibility with all devices.
  • Widgets are a convenience feature and should not be relied upon for safety-critical monitoring. Always use the full Cart IoT app or web dashboard for real-time device monitoring and alerts.

Intellectual Property

The Services and all content, features, and functionality thereof, including but not limited to text, graphics, logos, icons, images, software, firmware, and the design, selection, and arrangement thereof, are the exclusive property of Cart IoT and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Limitation of Liability

To the fullest extent permitted by applicable law, Cart IoT and its officers, directors, employees, agents, affiliates, successors, and assigns shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Our total liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the amount you have paid to Cart IoT in the twelve (12) months preceding the event giving rise to the liability.

WITHOUT LIMITING THE FOREGOING, CART IOT EXPRESSLY DISCLAIMS ANY LIABILITY FOR DAMAGES ARISING FROM OR RELATED TO:

  • FAILURE OR DELAY IN DELIVERY OF ALERTS, NOTIFICATIONS, OR MONITORING DATA.
  • SERVICE OUTAGES, WHETHER PLANNED OR UNPLANNED, INCLUDING THOSE CAUSED BY THIRD-PARTY SERVICE PROVIDERS.
  • FIRE, PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH RESULTING FROM OR RELATED TO THE USE OR FAILURE OF THE CHARGER SAFETY DEVICE OR MONITORING SERVICE.
  • RELIANCE ON THE CHARGER SAFETY DEVICE OR SERVICE AS A PRIMARY SAFETY OR LIFE SAFETY SYSTEM.
  • INSTALLATION, MODIFICATION, OR SERVICING OF THE DEVICE BY UNAUTHORIZED PARTIES.

THE CHARGER SAFETY DEVICE AND MONITORING SERVICE ARE PROVIDED FOR SUPPLEMENTAL MONITORING PURPOSES ONLY AND ARE NOT INTENDED TO REPLACE PROFESSIONAL FIRE DETECTION, FIRE PREVENTION, OR LIFE SAFETY EQUIPMENT.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
